WILCO CANADIAN TOUR TICKET GIVEAWAY CONTEST RULES


No purchase necessary. Open to residents of Canada of the age of majority in their province or territory of residence.

The “WILCO Canadian Tour Ticket Giveaway” Contest (the “Contest”) is sponsored by hmv Canada Inc., and Warner Music Canada Co. (together referred to as the “Sponsors”). The Contest begins at 12:00:01 AM (EST) on Monday, January 25, 2010 and ends at 11:59:59 PM (EST) on Friday, February 19, 2010 (the “Contest Period”). All entries must be received no later than 11:59:59 PM (EST) on Friday, February 19, 2010 (the “Contest Closing Date”) after which time the Contest will be closed and no further entries shall be accepted.

HOW TO ENTER: No purchase necessary. To enter, visit www.hmvdigital.ca, select the “Wilco Canadian Tour” Contest icon, and complete and submit the online entry form with your full name, complete mailing address (including postal code), daytime telephone (number including area code) and email address.

All entries must be received by the “Contest Closing Date in order to qualify. Limit one (1) entry per person per household or email address will be accepted during the Contest Period.

THE PRIZE: There are eleven (11) Prizes available to be won. Each prize (“Prize”) consists of two (2) tickets to one (1) concert on the Wilco Canadian Tour, with one (1) Prize winner in each participating market. Each Prize has an approximate value of CDN $140.

The Prize must be redeemed by Prize winner on the dates specified on the Winner Notification (as defined below). All travel to and from the event and accommodation expenses are the sole responsibility of the Prize winner.

Dates are at the discretion of the Sponsor and are subject to change without notice.

The Prize must be accepted as awarded without substitution and are not transferable, not for resale and have no cash surrender or redemption value.
The Sponsors reserve the right, in their sole discretion, to substitute another prize of equal or greater value for all or any component of the Prize, without liability, in the event that the Prizes or any component of the Prizes cannot be awarded as described for any reason.

ELIGIBILITY: The Contest is open to all residents of Canada who have reached the age of majority in the province or territory in which he/she resides, excluding all employees of the Sponsors, their affiliated companies or agents, their respective advertising or promotional agencies and the independent Contest organization, and any member of any such employee’s immediate family (regardless of place of residence) or household. In these Contest Rules, “immediate family” includes mother, father, brother, sister, son, daughter, partner or legal or common-law spouse.

PRIZE ADMINISTRATION: The random draws for the Prizes from all eligible entries received will be held at the offices of hmv Canada 10 (ten) days prior to each event (the “Random Draw Dates”). The odds of winning will be dependent on the number of eligible entries received during the Contest Period. Within twenty-four (24) hours of the applicable random draw, the selected entrant will be notified by email or telephone at the number recorded on his/her submitted entry (the “Winner Notification”). In order to be eligible to win, the selected entrant must (i) comply with all Contest Rules and (ii) correctly answer, unaided, a mathematical, time-limited, skill testing question. In the event that the selected entrant is unable to answer the question, cannot be reached within two (2) days of the Random Draw Date or otherwise does not meet all Contest conditions, his/her Prize will be forfeited and hmv Canada will award the Prize (subject to these Contest Rules) to another selected entrant drawn at random from the remaining eligible entries.

GENERAL: By entering the Contest, entrants agree to abide by these Rules and the decisions of the Sponsors and/or independent Contest organization with respect to all aspects of the Contest, which are final.

PUBLICITY RELEASE: By participating in the Contest, each Prize winner and his/her guest consents to the use of his/her name, address (city and province), voice, image and/or photograph, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsors with respect to this Contest, and waives all rights (including moral rights) with respect to printed, broadcast and other forms of publicity. Each Prize winner and his/her guest must provide written confirmation of the foregoing by signing Sponsor’s standard Declaration of Compliance with the Rules, Release and Consent to Publicity Form (the “Release”), which shall also serve as the Prize winner’s and his/her guest’s agreement to release and indemnify Sponsors and their respective parent(s), subsidiaries, affiliates and/or related companies and each of their officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising, media buying and promotional agencies from any liability in connection with the Contest and/or the Prize. The Release must be executed by the Prize winner and provided to Sponsors prior to such Prize winner being declared eligible to receive the Prize. If Sponsors do not receive a signed Release back from the selected entrant within two (2) days from the delivery of the Release to the entrant, then such entrant shall forego any forego any right or entitlement to the Prize and Sponsors may draw another entrant’s name.

Subject to approval of the Régie des alcools, des courses et des jeux, the Sponsors will not be responsible for late, lost, illegible, incomplete, inaccurate or destroyed entries, and all such entries are void. The Sponsors assume no responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof. Entry material/data not satisfying the entry requirements or that have been tampered with or altered are void. In the event it is determined that an entrant has entered in a fashion not sanctioned by these Contest Rules and/or has submitted more than the number of entries permitted by these Contest Rules, the entrant will be disqualified and all of the entries submitted by the entrant will be disqualified.

The Sponsors reserve the right to terminate or suspend this Contest or to amend the Contest Rules at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned, due to any reasons such as tampering or infection by computer virus, the Sponsors reserve the right to terminate the Contest and conduct the selection process from all previously received eligible entries. The Sponsors shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with or resulting from the Contest or the Prize(s), including but not limited to any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of the entrant’s participation in the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

All entries become the permanent property of the Sponsors and none will be returned. No correspondence will be entered into except with selected entrants. This Contest is subject to all applicable federal, provincial and municipal laws.

In the event of a dispute as to who submitted an electronic entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Selected entrants may be required to provide Sponsors with proof that he/she is the authorized account holder of the e-mail address associated with the selected entry.
For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

The Sponsors respect your right to privacy. By entering the Contest, you consent to the collection and use of your e-mail address, first name, last name, date of birth, mobile phone number, city, province, postal code, and daytime phone number (“Personal Information”) by the Sponsors to administer the Contest.

In addition, by opting in online at the time of entry, you consent to the use of your Personal Information to send you additional information regarding upcoming promotions, Contests and/or events from the Sponsors. hmv Canada Inc.’s privacy policy can be found here.
